P-1 visas: an overview

The P-1 visa is a non-immigrant visa classification for athletes and entertainers. Generally, a P-1 visa allows aliens who are athletes, internationally recognized artists, or entertainers to enter the U.S. to perform at a specific competition, event, or performance.

Requirements for a P-1 visa:

To qualify for a P-1 visa:

1. The alien must be a recognized athlete or entertainer who participates in high profile events.

2. The applicant must be employed by or under contract with a major U.S. sports league or organization.

3. Two or more of the following statements must be true about the alien:

a. The alien participated in a U.S. sports league in previous seasons;

b. The alien participated in international competitions with a national team;

c. A member of the sports media will give a written statement recognizing the alien's skills.

How a P-1 visa is filed:

No labor certification is required for P-1 visas. However, an employer still must file the P-1 petition on behalf of the alien. After the petition has been approved by the USCIS, the alien will then apply for the P-1 visa. When granted, the alien may travel to the U.S.
